Misechko and Partners successfully represented a client in a dispute for annulment of a financial leasing that violates the rights of the client

This agreement was signed by an individual with the leasing company "Etalon" which has a dubious reputation in the market of financial services, but, despite this, the company has enough "successfully" runs its business.

It should be noted that the Pecherskiy district court of Kiev adopted the decision of 10 March 2016 which dismissed the lawsuit on the recognition of the agreement of financial leasing invalid because of absence, in its opinion, violations of the rights of consumers from the Leasing company.

However, the decision of appellate instance of November 29, 2016 the decision of Pecherskiy district court of Kiev completely cancelled and adopted the new decision which completely satisfied claims which were put initially, namely is nullified the agreement of financial leasing signed between the parties and obliged to return the Leasing company to the client the money that paid by the client into the account of the Leasing company as an advance payment which initially under the terms of the agreement wasn't subject to return.
