Misechko & Partners Law Firm appealed the decision of the Kiev city council from 03.17.2016 regarding the prohibition of sale alcohol in small architectural forms, in the interests of the PO Association Kiev-MAF

Recall, March 17, 2016 Kyiv City Council adopted a decision №237/237 «On some issues of placement of temporary structures of trade, domestic, social, cultural or other purposes for entrepreneurial activity,» which was banned sale of alcoholic beverages in small architectural forms within the city.

Misechko & Partners Law Firm appealed in the interests of the PO «Association Kiev-MAF» in Kyiv District Administrative Court with a lawsuit for the cancellation of the decision of the Kyiv City Council as illegal and accepted in excess of authority.

The main arguments set out in the administrative complaint against the decision of the Kyiv City Council, is the lack of appropriate authority of the local self-government bodies in the sphere of circulation of alcoholic beverages and a violation procedure for the adoption of the regulatory act.
