The Lawyer’s Association «Misechko & Partners» successfully protected the interests of «Himexpress» LLC in a dispute with the chain of stores «Furshet» for the recovery of debts for the products supplied, which was considered by the Economic Court of Kyiv Region.

The main point was that during the period from 2016 to 2018, the client of the Lawyer’s Association «Misechko & Partners» carried out delivery of goods for its realization through the chain of stores «Furshet», at the same payments for the delivered goods were carried out partially or not carried out in general proving such refusal by not approach of term of payment which under the terms of the contract of delivery coincided with the moment of sale of goods to the end user.

By the time of appeal to the court by lawyers of the Lawyer’s Association «Misechko & Partners» the complex of actions for settlement of a dispute extrajudicially was held, however it was inefficient, through full ignoring of claims from «Furshet» company.

However, the Economic Court of the Kiev region agreed with the position of lawyers and recovered the debt in favor of «Himexpress» LLC and the penalties imposed for violation of the fulfillment of the obligation.
