Misechko & Partners law firm has acted as legal counsel of «Panalpina World Transport L.T.D.» in litigation with the Regional Office of the State Property Fund of Ukraine in Kyiv region, State Enterprise Boryspil International Airport in regard to extension of state property rental agreement.

It’s worth to remind that today Regional Office of the SPFU in Kiev region is in dispute with a number of transport sector companies concerning the rent rate for using the state property. Since September 2011, the State Property Fund has begun to consider customs brokers as brokerages. In practice, this means that rental rates for transport companies should be increased more than twice.

The court accepted the position of the client of Misechko and Partners law firm and ruled that the defendants shall enter into an additional agreement with the plaintiff to extend the lease of state property without changing the rent price.

We are pleased to note that this decision is a kind of precedent - the first in a series of disputes of transport industry companies with the state body which will hopefully force SPFU to revise its position.
