Misechko & Partners successfully represented the interests of the Ukrainian woodworking company in the ICAC at the Ukrainian CCI
Ukrainian woodworking company, client of Misechko & Partners, was supplied in favor of Firma LITKE (Germany) wood products and coniferous timber with post-delivery payment terms - 30 days from the date of customs clearance of the goods.
Firma LITKE violated own obligation and didn’t pay the cost of the delivered products, this fact became the basis for our client's to filed the claim to the International Commercial Arbitration Court at the Ukrainian Chamber of Commerce and Industry.
The arbitration agreement of the parties on the transfer of their dispute to the International Commercial Arbitration Court at the Ukrainian Chamber of Commerce and Industry and the possibility to apply the norms of the current legislation of Ukraine to the disputed legal relations was clearly stipulated by the terms of the foreign economic contract.
After more than six months of proceedings, the court took into account the presented evidence and satisfied our Client's claim in full, covering a general debt fines arbitration fees, and legal costs.
