The Kyiv Economic Appeal Court upheld lawfulness of claims of the trade group Status a client of Misechko & Partners law firm

23 June 2015 the Kyiv Economic Appeal Court upheld a decision of the Economic Court of Kyiv on satisfaction of claims of the trade group «Status» against «Netfix» company (ТМ «Brainberry») on termination of custom software development agreement (website) and collection of the advanced payment.

The dispute arose between the parties because of non-compliance with terms of design of custom software by «Netfix» company and as a result the client of «Misechko and Partners» incurred losses in the amount of the advanced payment.

The Kyiv Economic Appeal Court upholding a decision of the first instance confirmed the trade group «Status» right to refuse from acceptance of performance of obligations in consequence of the loss of the interest because of breach of terms by «Netfix» company.

Representation and protection of client’s interests were carried out by a team of lawyers consisting of a partner Volodymyr Misechko and lawyers Roman Sydorenko and Vadym Kukhta.

The Trade group «Status» is a retail chain of business accessories.
