Misechko & Partners in Chinese arbitration

A new case in our portfolio is the representation of the interests of the Ukrainian company «Energy Hub» LLC in the Shanghai division of CIETAC (Chinese International Commission on Economic and Trade Arbitration). The defendant in the arbitration proceedings is the Chinese company «Inner Mongolia Pulis Chemical Co».
 
About CIETAC
The China International Economic and Trade Arbitration Commission (CIETAC), founded in 1956, is the number one commercial arbitration institution out of more than 200 such institutions in China. It is one of the oldest, busiest and largest arbitrations in the world. Currently, the CIETAC panel consists of 1,897 arbitrators.
 
It is this arbitration institution that is used most often by foreign companies. CIETAC has handled more than 50,000 foreign arbitration cases with parties from more than 150 countries and regions around the world.
 
About the case
On February 5, 2023, our client, «Energy Hub», LLC (Ukraine), signed an agreement with the company «Inner Mongolia Pulis Chemical Co» (China) for the supply of goods and made an advance payment in accordance with it. But the Chinese company did not deliver the goods, which was the reason for the appeal to the court.
 
The contract for the supply of goods contains an arbitration clause regarding consideration of a possible dispute between the parties in CIETAC. That is why the lawyers of Misechko & Partners prepared and sent the application for arbitration to that very place. On January 3, 2024, the China International Economic and Trade Arbitration Commission accepted the case and opened the proceedings.
