Accreditation of a representative office of a foreign charitable organization

In times of war, Ukraine is in the focus of many foreign charitable organizations.
 
Carrying out charitable activities through a separate subdivision of a foreign charitable organization has a number of advantages. These include established cooperation with the parent organization, the status of a foreign organization, tax advantages, and the employment of foreign employees without obtaining permission from the employment authority. Foreign employees and volunteers can also obtain residence permits in Ukraine.
 
A separate subdivision of a foreign non-governmental organization is accredited in Ukraine without being granted legal entity status and is not a taxpayer. However, the representative office is obliged to keep accounting records.
 
Accreditation of a representative office or branch of a foreign non-profit organization in Ukraine is carried out by the Ministry of Justice of Ukraine.
 
To accredited as a representative office or branch of a foreign charitable organization, the following documents are required:
  1. Application for state registration (accreditation) of a separate subdivision;
  2. A copy of a document issued by an authorized body of a foreign state confirming the registration of a charitable organization (registration certificate, extract, etc.);
  3. Copies of the founding documents of a foreign charitable organization (charter);
  4. Decision (minutes) of the authorized body of the foreign charitable organization on the establishment of a separate subdivision of the foreign charitable organization in Ukraine and appointment of its head (director);
  5. Charter (regulations) of a separate subdivision (if the charter (regulations) is provided for by the decision to establish a separate subdivision);
  6. A notarized power of attorney in the name of the head of a separate subdivision of a foreign charitable organization, executed in accordance with the legislation of the state in which it was issued;
  7. An extract, extract or other document from a trade, banking, court register, etc. confirming the registration of a non-resident legal entity in the country of its location.
 
All documents to be issued in a foreign country must be notarized and apostilled.
 
Cost:
The cost of our services for supporting the accreditation of a representative office of a foreign charitable organization will be EUR 2000.00, and not include translation and certification fees.
