What reasons of punishment of Dynamo Kiev?

On 25 November 2015 the UEFA Control, Ethics and Disciplinary Body (CEDB) has announced the decisions regarding the UEFA Champions League group stage match FC Dynamo Kyiv v Chelsea FC (0-0) played on 20 October in Ukraine.

Charges against FC Dynamo Kyiv:

  • Racist behaviour - Art. 14 of the UEFA disciplinary regulations (DR)
  • Crowd disturbances - Art. 16 (2) DR
  • Stairways blocked - Art. 38 of the UEFA safety & security regulations

As reference, UEFA has two disciplinary bodies – the Control, Ethics and Disciplinary Body and the Appeals Body.

The Control, Ethics and Disciplinary Body deals with disciplinary cases, both on and off the field, which arise from the UEFA Statutes, regulations and decisions of UEFA that do not fall within another committee or body's competence.

The Appeals Body handles appeals against disciplinary decisions taken by the Control, Ethics and Disciplinary Body.

So, try to understanding the reason of punishment of Dynamo Kiev

Article 14 of the UEFA disciplinary regulations - Racism, other discriminatory conduct and propaganda.

According to this article, If one or more of a member association or club’s supporters engage in the behaviour which insults the human dignity of a person or group of persons on whatever grounds, including skin colour, race, religion or ethnic origin, the member association or club responsible is punished with a minimum of a partial stadium closure.

The following disciplinary measures apply in the event of recidivism:

  1. a second offence is punished with one match played behind closed doors and a fine of € 50,000;
  2. any subsequent offence is punished with more than one match behind closed doors, a stadium closure, the forfeiting of a match, the deduction of points or disqualification from the competition.


Article 16 of the UEFA disciplinary regulations - Order and security at UEFA competition matches.

Host associations and clubs are responsible for order and security both inside and around the stadium before, during and after matches.

However, all associations and clubs are liable for the following:

  1. the invasion or attempted invasion of the field of play;
  2. the throwing of objects;
  3. the lighting of fireworks or any other objects;
  4. the use of laser pointers or similar electronic devices;
  5. the use of gestures, words, objects or any other means to transmit any message that is not fit for a sports event, particularly messages that are of a political, ideological, religious, offensive or provocative nature;
  6. acts of damage;
  7. the disruption of national or competition anthems;
  8. any other lack of order or discipline observed inside or around the stadium.


Article 38 of the UEFA safety & security regulations – Public passageways.

The match organiser must take measures to ensure that all public passageways, corridors, stairs, doors, gates and emergency exit routes are kept free of any obstructions, which could impede the free flow of spectators.

According to article 6 of the UEFA disciplinary regulations the following disciplinary measures may be imposed on member associations and clubs: annulment of the result of a match; order that a match be replayed; deduction of points (for the current and/or a future competition); order that a match be forfeited; playing of a match behind closed doors; full or partial stadium closure; playing of a match in a third country; and fines from €100 till €1,000,000.

FC Dynamo Kyiv has been ordered to play their next three UEFA competition matches as host club behind closed doors. The third match is suspended for a probationary period of three years. The club has also been fined €100,000.

Appeals, deadlines and fees

According to article 53 of the UEFA disciplinary regulations the parties directly affected by a decision and the ethics and disciplinary inspector all have the right to appeal.

A declaration of the intention to appeal against a decision by the Control, Ethics and Disciplinary Body must be lodged with the UEFA administration, in writing, for the attention of the Appeals Body, within three days of notification of the relevant decision with grounds.

Within five days of the expiry of the time limit for the declaration of the intention to appeal, the appellant must file, in writing, the grounds for appeal. The appeal fee is €1,000, payable on submission of the grounds for appeal at the latest.

Important. An appeal has no staying effect. The chairman may, on receipt of a reasoned request, award a stay of execution.

The appeal instance will appoint the hearing date and after court hearing the decision can be upheld or changed.

Consequently, in the case of absence of a request from Dynamo Kyiv to suspend the contested decision or the decision of Appeal to refuse the suspension of the contested decision, the match Dynamo Maccabi will be held without spectators.
